Terms of Service

The HSE Genius service is operated by Kaimakiweb S.r.l. (VAT: P.IVA 04028790121), registered in Italy. For any communication: info@hsegenius.com.

HSE Genius is a SaaS platform that enables the automatic analysis of Safety Data Sheets (SDS) using artificial intelligence, with data verification against the ECHA portal and calculation of HP hazard classes in accordance with Regulations (EU) No. 1357/2014 and 2017/997. The service is accessible via https://hsegenius.com and the application at https://kaimakicloud.hsegenius.com.

Use of the service implies full acceptance of these Terms of Service. If you do not accept these terms, you may not use the platform. These terms may be updated; material changes will be communicated by email with at least 30 days' notice.

To access the service, you must create an account by providing a valid email address and password. You are responsible for the confidentiality of your credentials and all activities carried out through your account. HSE Genius reserves the right to suspend or close accounts in cases of misuse or violation of these terms.

PDF files of Safety Data Sheets uploaded by the user are securely transmitted to HSE Genius servers solely to enable AI analysis. The original PDFs:

• are not transferred to third parties;

• are not published publicly;

• are retained for the time necessary to provide the service and for the period set out in our Privacy Policy;

• can be deleted by the user at any time through account settings.

By accepting these terms, the user consents to the structured data automatically extracted from analysed SDS — including but not limited to H phrases, CAS numbers, chemical composition, HP classifications and ECHA verification status — being aggregated in completely anonymous form.

Such aggregated data may be used to:

• power a public SDS data search engine (the "HSE Genius Public Database");

• improve the accuracy of HSE Genius AI models;

• produce aggregated and anonymous statistics on the use of chemical substances in Europe.

Under no circumstances will the following be published or shared: original PDF files, the name or identifying data of the user, the name of the company that uploaded the SDS, or any other information that could lead back to the identity of the uploader.

The user may withdraw consent to aggregation at any time from account settings. Withdrawal does not have retroactive effect on data already aggregated in anonymous form.

Access to the service requires valid credits or an active subscription. The free trial includes 50 credits with no expiry. Each SDS analysed uses 1 credit. Credits are non-refundable except as required by law. Pricing plans are described in detail at https://hsegenius.com/en/#attivazioni.

The HSE Genius platform, software, source code, trademark and all content produced by HSE Genius are the exclusive property of Kaimakiweb S.r.l. and protected by copyright law. Data uploaded by the user remains their property. The user grants HSE Genius a limited, non-exclusive, non-transferable licence to process such data for the purpose of providing the service.

HSE Genius applies cybersecurity measures aligned with the requirements of the NIS2 Directive (EU Directive 2022/2555), including encryption of data in transit and at rest, access control, authentication and incident management procedures.

HSE Genius also provides a support tool for HSE regulatory compliance. The results of AI analysis (HP classifications, ECHA verification, etc.) are provided for indicative purposes only and do not replace the advice of a qualified HSE professional. The user is responsible for the final verification of results and operational decisions taken on the basis thereof.

To the extent permitted by applicable law, Kaimakiweb S.r.l. shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the service. HSE Genius's maximum liability is limited to the amount paid by the user in the 12 months prior to the event giving rise to the liability.

The user may close their account at any time from settings. HSE Genius may suspend or terminate access to the service in the event of a breach of these terms, with at least 7 days' notice except in cases of serious abuse or security violations.

These terms are governed by Italian law. Any dispute arising from the use of the service shall be subject to the exclusive jurisdiction of the Court of Varese, except where mandatory consumer protection laws require otherwise.
